Collection and Use of Personal Information

Personal information is data that can be used to identify or contact a single person. You may be asked to provide your personal information anytime you are in contact with Apjax or an Apjax affiliated company. Apjax and its affiliates may share this personal information with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve our products, services, content, and advertising. You are not required to provide the personal information that we have requested, but, if you chose not to do so, in many cases we will not be able to provide you with our products or services or respond to any queries you may have. Here are some examples of the types of personal information Apjax may collect and how we may use it:


What personal information we collect

When you create your Apjax account, purchase a product, download a software update, connect to our services, contact us or participate in an online survey, we may collect a variety of information, including your name, mailing address, phone number, email address, contact preferences, device identifiers, IP address, location information, credit card information and profile information where the contact is via social media. When you share your content or invite others to participate in Apjax services, Apjax may collect the information you provide about those people such as name, mailing address, email address, and phone number. Apjax will use such information to fulfill your requests and provide the relevant product or service.


How we use your personal information

We may process your personal information: for the purposes described in this Privacy Policy, with your consent, for compliance with a legal obligation to which Apjax is subject, for the performance of a contract to which you are party, in order to protect your vital interests, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by Apjax or a third party to whom it may be necessary to disclose information. The personal information we collect allows us to keep you posted on Apjax's latest announcements, software updates, and upcoming events. If you don't want to be on our mailing list, you can opt-out anytime by contacting us. We also use personal information to help us create, develop, operate, deliver, and improve our products, services, content and advertising, and for loss prevention and anti-fraud purposes. We may also use your personal information for account and network security purposes, including in order to protect our services for the benefit of all our users, and pre-screening or scanning uploaded content for potentially illegal content, including child sexual exploitation material. Where we use your information for anti-fraud purposes it arises from the conduct of an online transaction with us. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our customers and our services. For certain online transactions we may also validate the information provided by you with publicly accessible sources. We may use your personal information, including date of birth, to verify identity, assist with identification of users, and to determine appropriate services. From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Apjax, you may not opt out of receiving these communications. We may also use personal information for internal purposes such as auditing, data analysis, and research to improve Apjax's products, services, and customer communications.


How we use your customers information

We also obtain information about your customers on your behalf when they transact with you through Apjax product, services or applications. This may include: Device Information - Information about Your Customer's device including hardware model, operating system and version, device name, unique device identifier, mobile network information, and information about the device's interaction with our Services. Identification Information - Your Customers' name, email address, mailing address, phone number and contact information. Location Information - The location of Your Customer's device if enabled or shared. Transaction Information - When Your Customers use Apjax to make or record payments to you, we may collect information about when and where the transactions occur, the names of the transacting parties, a description of the transactions which may include item-level data, the payment or transfer amounts, billing and shipping information, and the devices and payment methods used to complete the transactions. Use Information - Information about how Your Customers transact with you using our Services, including access time, "log-in" and "log-out" information, browser type and language, country and language setting on your device, IP address, the domain name of Your Customer's internet service provider, other attributes about Your Customer's browser, mobile device and operating system, features Your Customer uses, and the date and time of use of the Services. Other Information You or Your Customers Provide - Information that Your Customers voluntarily provide you or that you input into Apjax systems about your Customers, including survey responses; promotions, or other prospective seller marketing forms or devices; suggestions for improvements; or any other actions performed when they transact with you using Apjax.



Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it: We may collect information such as occupation, language, zip code, area code, unique device identifier, referrer URL, location, and the time zone where an Apjax product or service is used so that we can better understand customer behavior and improve our products, services, and advertising. We may collect information regarding customer activities on our website or other products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered non-personal information for the purposes of this Privacy Policy. We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address. With your explicit consent, we may collect data about how you use your applications in order to help app developers improve their apps. If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.



Cookies and Other Technologies

When you use our website, online services or applications, we obtain certain information using automated technologies, such as cookies, web server logs, web beacons, and other technologies. A "cookie" is a text file that websites send to a visitor's computer or other internet-connected device to uniquely identify the visitor's browser or to store information or settings in the browser. A "web beacon," also known as an internet tag, pixel tag, or clear GIF, is a tiny graphic image that may be used in our websites or emails. We use these automated technologies to collect your device information, internet activity information, and inferences as described above. These technologies help us to, remember your information so you do not have to re-enter it, track and understand how you use and interact with our online services and emails, tailor our online services to your preferences, measure how useful and effective our services and communications are to you and otherwise manage and enhance our products and services. We set some of these automated technologies ourselves, but others are set by third parties who deliver services on our behalf. For example, we may use other companies' web analytics services (described in the "Third-Party Sites and Services" section), which use automated technologies to help us evaluate how customers use our websites. Please note, however, that without cookies all of the features of our online services may not work properly. As is true of most internet services, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data. We use this information to understand and analyze trends, to administer the site, to learn about user behavior on the site, to improve our product and services, and to gather demographic information about our user base as a whole. Apjax may use this information in our marketing and advertising services.



Protection of Personal Information

Apjax always takes the security of your personal information very seriously. We take reasonable measures, including administrative, technical, and physical safeguards, to protect your information from loss, theft, and misuse, and unauthorized access, disclosure, alteration, and destruction. We also use SSL Certificates and vulnerability scanning to enhance the security of our site. However, the internet is not a 100% secure environment, and we cannot guarantee absolute security of the transmission or storage of your information. We recommend that you use anti-virus software, routine credit checks, firewalls, and other precautions for extra protection. We hold information about you with the assistance of third-party service providers. When you use some Apjax products, services, or applications or post on an Apjax forum, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Please take care when using these features.



Your Privacy Rights

You can help ensure that your contact information and preferences are accurate, complete, and up to date by signing in to your Apjax account page. For other personal information we hold, we will provide you with access for any purpose including to request that we correct the data if it is inaccurate or delete the data if Apjax is not required to retain it by law or for legitimate business purposes. We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes as described earlier.


California

The California Consumer Privacy Act provides California consumers with the right to obtain from Apjax information about the personal information about you that we collect, use, and disclose. You can exercise your rights through an authorized Apjax specialist by contacting us.



Location-Based Services

To provide location-based services on Apjax products or services, Apjax and our partners and licensees, such as maps data providers, may collect, use, and share precise location data, including the real-time geographic location of your Apjax computer or device. Where available, location-based services may use GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your devices' approximate location. Unless you provide consent, this location data is collected anonymously in a form that does not personally identify you and is used by Apjax and our partners and licensees to provide and improve location-based products and services. For example, your device may share its geographic location with application providers when you use their location services. Some location-based services offered by Apjax, require your personal information for the feature to work.



Third-Party Sites and Services

Apjax websites, products, applications, and services may contain links to third-party websites, products, and services. Our products and services may also use or offer products or services from third parties. Information collected by third parties, which may include such things as location data or contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.



Children

We understand the importance of taking extra precautions to protect the privacy and safety of children using any Apjax product or service. Our Services are general audience services not directed at children under the age of 13. If we learn that we have collected the personal information of a child under 13, we will take steps to delete the information as soon as possible.



Law enforcement

You agree that we may disclose your information to authorities if compelled to by a court order. Additionally, you agree that we may disclose your information if we reasonably believe that you have violated a US law or Privacy Policy or if we believe that a third party is at risk of bodily harm. In the event that we receive a subpoena affecting your privacy, we may elect to notify you to give you an opportunity to file a motion to quash the subpoena, or we may attempt to quash it ourselves, but we are not obligated to do either. We may also proactively report you and release your information without receiving any request to third parties where we believe that it is proper to do so for legal reasons, such as instances where we believe your publications violate any law of the United States or any other country having jurisdiction over us, our site, products. You release us from any damages that may arise from or relate to the release of your information to a request from law enforcement agencies or private litigants. We may release your information under the conditions listed in this paragraph whether it is to individuals or entities and to any state or Federal authorities within the United States, or elsewhere.



Changes to this Privacy Policy

We may amend this Privacy Notice from time to time by posting a revised version and updating the "Effective Date" above. The revised version will be effective on the "Effective Date" listed. We will provide you with reasonable prior notice of material changes in how we use your information, including by email, if you have provided one. If you disagree with these changes, you may cancel your account at any time. If you keep using our Services, you consent to any amendment of this Privacy Notice.
